Embasado em pesquisa bibliográfica, no presente artigo, busca-se compreender a definição de desespero presente, de maneira original e pungente, na filosofia de André Comte-Sponville, e relacioná-la com a construção da felicidade. Segundo Sponville, o desespero é condição necessária e indispensável para compreender a natureza e ou matéria como fundamento de si mesma. Todos os males da humanidade são debitados, segundo o pensador em estudo, da virtude teologal da esperança. Sponville se apressa em apresentar sua própria virtude pessoal: o desespero, (...) remédio contra o veneno da esperança. A felicidade, por sua vez, é o resultado de todo desespero. Quem nada espera, realiza mais facilmente todos os seus desejos e se rejubila com a vida tal como ela é. Nesse sentido, a felicidade é verdadeira e possível. Se verá, portanto, que a sabedoria do desespero abri caminhos para a construção de uma felicidade desesperada. (shrink)

Este artigo investiga a presença da semiótica de C. S. Peirce na filosofia de Gilles Deleuze. O interesse pelas ideias de Peirce se deu a partir da parceria que Deleuze estabeleceu com Félix Guattari, e que se manifesta no uso dos conceitos de semiótica e diagrama em sua obra conjunta “Mil platôs”. Mais tarde, Deleuze faria um uso mais aprofundado da semiótica de Peirce em seus livros e cursos sobre cinema.

Na Modernidade filosófica, a expressão sui iuris torna-se comum nos textos políticos, em especial a partir do momento em que uma linguagem dos direitos subjectivos naturais se vai sedimentando e traduzindo uma certa perspectiva da liberdade individual. Assim, sui iuris é considerada expressão de direito designando um âmbito de autonomia ou independência individuais, uma espécie de espaço soberano de um direito pessoal. Em Spinoza, o sui iuris surge com frequência, mas só no Tratado Político atinge a sua máxima expressão, dentro (...) do binómio sui iuris / alterius iuris, o qual é habitualmente identificado com um de autonomia / heteronomia. Tentar-se-á aqui demonstrar que o sui iuris em Spinoza passa por uma transformação radical: não só não é necessariamente incompatível com o alterius iuris, como é-lhe dada uma dimensão epistemológica que se coaduna com uma soteriologia. O presente texto versa sobre as utilizações políticas que a conversão dos grupos indígenas suscitou na fronteira amazônica. A fronteira a que aludimos aqui diz respeito aos rios Marañon, Solimões e Negro, onde os limites das colônias europeias se encontravam. Se por um lado havia o caráter espiritual, em reduzir os indígenas a fé católica, por outro, as conversões foram amplamente utilizadas pelos estados ibéricos para garantir sua zona de influência, além de garantir a supremacia econômica no vale amazônico. E (...) além dos ibéricos, a conversão foi uma política na qual os indígenas se aproveitaram para tirar vantagens da condição de “vassalo do rei”, que o fato de se tornar católico expressava. Desse modo, o presente trabalho dialoga com os estudos de fronteira, sobretudo, com a noção de Missão como instituição de fronteira, além do Protagonismo Indígena, em demonstrar a perspectiva dos grupos nativos, frente ao processo de conversão. BackgroundOrgan transplantation represents the most effective and acceptable therapy for end-stage organ failure. However, its frequent practice often leads to a shortage of organs worldwide. To solve this dilemma, some countries, such as Portugal, have switched from an opt-in to an opt-out system, which has raised concerns about respect for individual autonomy. We aimed to evaluate whether young university students are aware of this opt-out system so that they can make informed, autonomous and conscious decisions, as well as to identify (...) the factors that determine a positive attitude toward post-mortem organ donation.MethodsAn observational, cross-sectional study was developed and a questionnaire was administered to first-year students from six faculties of the University of Porto.ResultsOf the 841 participants, 60% were unaware that Portugal had adopted an opt-out system. Among the informed individuals, their main sources of information included social media, internet, and family. Furthermore, only 48% of all participants agreed with the current opt-out system. Female sex (p = 0.049; OR 1.393), knowledge of the law (p < 0.001; OR 4.749) and family being the primary source of information (p < 0.001; OR 2.855) were independent factors associated with a positive attitude toward post-mortem organ donation law.ConclusionsThere is a significant lack of knowledge among young university students regarding the presumed post-mortem organ donation law and how it works. Female sex, having family as a primary source of information and being aware of the presumed post-mortem organ donation law are the strongest independent factors that determine a positive attitude toward the opt-out system. Epistemic impairment has been the decisive yardstick when excluding infants from political agency. One of the suggestions to bypass the epistemic requirement of political agency and to encourage the inclusion of infants in representative democracies is to resort to proxies or surrogates who share or advocate interests which may be coincidental with their interests. However, this solution is far from desirable, given that it privileges the political agency of parents, guardians and trustees over other adult citizens. This article offers an (...) alternative to this conceptual frame of reference by making a case for the political agency of infants. Firstly, it maintains that political agency can be understood in terms of the several facets involved in political representation. Secondly, it claims that the all-affected principle can be reformulated as an ‘infant-affected-interests principle’ in light of which infants are members of the class of the represented. Thirdly, it explores the ways through which this political agency can occur without having to resort to alternative conceptions of representation. The conclusion ascertains that infant enfranchisement is highly undesirable and that there are more viable forms to promote infant political agency, such as virtual representation, infant-beneficial principles of political action and ombudspersons for infants. This review shows the various tools used to implemente the food quality system in food establishments. Presenting the various laws that subsidize this process, establishing criteria and instrumentes for a correct implementation of the quality system in order to offer adequate hygiene processes in the production of safe food, in addition to favoring the maintenance of companies in the consumer market. The implementation of food safety management systems such as Good Manufacturing Practices (GMP), Standard Operating Procedures (SOP) e Hazard Analysis (...) and Critical Control Points (HACCP), in order to guarantee the safety of the food served and portray the organization of the company. It is essential to implement these systems ensuring the quality of the servisse (planning, control and improvement). In order to achieve healthy criteria related to foodstuffs, it is necessary to implement quality programs as prerequisites of the Hazard Analysis System and Critical Control Points in food services. Regulating and inspecting are just a few points that guarantee food security, since food that does not pose a health hazard to consumers is considered safe. (shrink)

A theory of intergenerational justice consists in the study of the moral and political status of the relations between present and past or future people, more specifically, of the obligations and entitlements they can potentially generate. The challenges that justify talking about responsibilities between generations are myriad. And the disputes they prompt can focus on the past just as much as on the present, even though the fact that the human species has reached a state of technological progress that enables (...) it to have an irredeemable impact on the planet and perhaps even endanger future human existence tends to make concerns about the future more pressing. Debates on intergenerational justice are twofold. The first revolves around the issue of whether claims of justice across generations whose members' lifetimes do not necessarily overlap could be justified. And the second revolves around the specific conception of justice in play, that is, around the nature of the standard that must be applied as well as around the identification of the contents of the duties that present generations supposedly have vis-à-vis past or future generations. This survey article depicts the conceptual and argumentative framework in which these debates are set. It aims to outline certain of the main features shared by the most influential contemporary theories of intergenerational justice, and the problems inherent in them. It concludes by suggesting that, even though the idea of succeeding generations is merely an abstraction, there are specific empirical states of affairs that require different theoretical responses to intergenerational justice. El presente artículo tiene como objetivo la presentación y discusión de las representaciones de los niños sobre el papel del Gestor de la Palabra (GP). Se trata de un recurso concebido y desarrollado en el ámbito de las sesiones de Filosofía para Niños, de acuerdo con la metodología de la comunidad de investigación filosófica (community of philosophical inquiry) de Matthew Lipman (2003) y de Ann Margaret Sharp (1987). Designamos como “Gestor de la Palabra” al miembro de la comunidad de investigación (...) responsable por escoger, durante o diálogo, quien habla y cuando habla. Surge como una estrategia para envolver activamente a los niños en los procedimientos de la sesión y su importancia se extiende hasta las dimensiones pedagógica y filosófica de la comunidad de investigación. Se adoptó como metodología el estudio de un caso exploratorio, recorriéndose a un cuestionario para realizar o levantamiento de las formas de pensar de los niños. Del análisis de contenido del cuestionario, emergieron tres subcategorías en la definición de lo que el GP debe y no debe hacer: cognitiva, ética y social. De estas, es la dimensión ética aquella que revela mayor incidencia de respuestas, con implicaciones para dimensiones fundamentales de la Filosofía para Niños como sean la promoción del caring thinking y la noción de autoridad en la comunidad de investigación. Así, el artículo se divide en cinco secciones: la Filosofía para Niños como área científica y como programa curricular, con incidencia en el concepto de “comunidad de investigación filosófica”; el GP en el ámbito de la comunidad de investigación; el enfoque metodológico del estudio; la presentación de los resultados y su respectiva discusión. In a time marked by the development of innovative treatments in healthcare and the need for health professionals to deal with resulting ethical dilemmas in clinical practice, this study was developed to determine the influence of the bioethics teaching on the moral competence of medical and nursing students. The authors conduct a longitudinal study using the Moral Competence Test extended version before and after attending the ethics curricular unit, in three nursing schools and three medical schools of Portugal. In this (...) questionnaire the participant is confronted with three ethical dilemmas and asked to evaluate arguments for and against the attitude of the main character. For both nursing and medical students, C-score was lower after the attendance of the ethics curricular units, with a statistically significant decrease in the total score for nursing students and a decrease not statistically significant for medical students. A multivariate analysis did not find any association between this decrease and gender, course, or age. The phenomenon of moral segmentation was observed, with better performance in the worker and judge dilemma, than in the doctor dilemma. These results highlight the need to reflect on the curricular strategies that can be implemented for health professionals to better develop moral competence and decision-making, allowing for the provision of humanized health care. In representative democracies, the absence of responsiveness by elected officials to the interests of the represented often generates problems of legitimacy, accountability and effectiveness. However, responsiveness also tends to narrow the time horizons of democratic decision-making and promote short-termism. This paper advances the notion that responsiveness to interests involving distant time horizons is possible by reconfiguring the franchise in a time-sensitive and future-oriented way. It is divided into two parts. The first pinpoints a few inconsistencies in the available proposals for (...) making responsiveness and the long term compatible (e.g., promoting youth turnout, narrowing the franchise to robust epistemic fitness, establishing future-oriented institutions). The second advances the creation of temporal electoral circles operating alongside territorial electoral circles in order to prompt responsiveness to multitemporal interests. The conclusion asserts that this kind of franchise design is the best available option for introducing temporal aspects into the character of democratic representation. (shrink)

This paper adopts justificatory moral pluralism – a multilevel framework for justifying the choice by different agents of the most appropriate norms and values to guide their decisions and actions – to climate change. Its main objective is to investigate how ethics may effectively help achieve a better result in deciding how to mitigate, adapt, or compensate by enhancing the moral acceptability of the available policies or actions that are most likely to counter the effects of climate change. JMP presents (...) agents – individuals, nonstate, and state – with a thorough yet flexible process of matching policies and actions with ethical theories, raising the robustness of moral reasons for politically efficient and individually motivating courses of action against climate change. JMP triggers climate responsibility and sensibility in agents, engaging them in discussing and finding out individually and collectively the most acceptable paths for the decarbonisation transition that is fast approaching. There is a gap between Rand 'sethical egoism and today's global capitalism on at least six points. Since her version of " capitalism : the unknown ideal" addresses none of these points, it cannot resemble the reality of today's global capitalism. The connection between Objectivist ethics and politics is preserved by a possible change in her minarchical political philosophy. This will mean that there is no necessary connection between ethical egoism and minarchism or between ethical egoism and minimal government intervention. (...) Legal positivism understands natural law as performing classifying connections between morality and law as tests of legal validity: if a norm with some pretence to legality contradicts a moral good, it cannot be called a legal norm. The new natural law school, however, claims that natural law develops qualifying connections between morality and law: tests of legal validity are performed by non-moral criteria such as due enactment or efficacy, and morality determines not what the law is, but rather which law (...) is legally binding and which is legally defective. This article will demonstrate that Aquinas's endorsement of the lexeme lex iniusta non est lex cannot be interpreted in any of these senses. Rather, Aquinas's strong version of natural law indicates clearly that it can indeed be a classifying criterion of positive law, and that it cannot be the only and exclusive criterion of legal validity. This paper engages with Suárez’s writings on the origins of political power in order to ascertain whether he can be considered a social contract theorist at all. It focuses on specific details of his consent theory, namely the ‘who’, the ‘what’, the ‘how’ and the ‘what for’ of the agreements that originate government. The conclusion shows that even though his systematic treatment of contracts falls short of becoming a social contract theory in the same way as modern contractualist thinkers, he (...) can still be considered a social contract theorist in the tradition of the School of Salamanca. Although from a philosophical perspective, many reflections can be brought up about the theorizing process, in this essay, we aim to reflect on the importance of the alignment between ontology and epistemology. This is particularly relevant because deeper discussions about the philosophical roots that underlay the theorizing processes remain as a lack in organizational and management studies. To support our work, we adopted the epistemic-ontological alignment model as a conceptual tool and the Resource-Based View (RBV) and some of its questionings (...) as an example to carry out a reflection exercise about its epistemic-ontological alignment. RBV is a theory that plays a prominent role in management studies, especially in the strategy field. Nevertheless, discussions regarding RBV philosophical foundations are not common in the mainstream of strategic management. After our analysis, we advise that scholars care about the philosophical roots of their theoretical proposals to promote constructive dialogue in their research communities. This can avoid empty discussions and criticisms based on incongruous worldviews. Our reflections also suggest that future research should embrace the plurality of paradigms as a source of renewal and transcendence in the production of knowledge. A multi-paradigmatic movement towards more eclecticism in Administrative Science can help produce new and underexploited combinations of knowledge in the theorizing process. (shrink)

Resumo: O presente estudo investiga de modo introdutório como se articulam as noções de feminino, sexualidade e intelecção em Tomás de Aquino e Christine de Pizan. Buscamos entender, aqui, se, para os autores, a sexualidade humana possui alguma função na operação que apreende o inteligível, quer dizer, investigamos se a característica normal, material e natural de determinado corpo humano em possuir estes ou aqueles órgãos naturais têm influência na operação intelectual. Nesta investigação, ademais, nos concentramos na tese afirmada por Tomás (...) segundo a qual a potência intelectual humana do animal fêmea é inferior à potência intelectual do animal macho e, isso, simplesmente porque o animal fêmea é fêmea, uma tese totalmente arbitrária e inconsistente, se lida a partir de noção de feminino de Christine. Para cumprir com o objetivo, o texto possui três seções. Na primeira, apresentamos a tese de Christine segundo a qual a fêmea humana é perfeita por natureza. Na segunda, por sua vez, analisamos a tese tomista segundo a qual não há uma mecânica própria para a geração da fêmea vivípara. Na terceira, enfim, investigamos os fundamentos da asserção tomista sobre a deficiência da intelecção feminina. (shrink)

This paper aims at answering some of the objections to the NIP’s criticism of the idea of rights of future persons. Those objections usually adopt different perspectives depending on how they understand differently the nature of the correlativity between rights and duties – some adopt a present-rights-of-future-persons view, others a future-rights-of-future-persons view, others a transitive present-rights-of-present-persons view, and others still an eternalist view of rights and persons. The paper will try to show that only a non-transitive present-rights-of-present-persons view can survive (...) the challenges posed by the notion of correlativity inherent in the NIP, and thus preserve rights language when discussing the future. This view is proved also more suitable for the legal and political realms, where policies and law-making are usually more concerned with present addressees and short term effects. (shrink)

This paper develops a future-oriented and person-centred normative argument based on expectancies that is immune to most of the problems identified in the rights of future persons. The argument unfolds in four parts. The first draws on the notion of expectancies present in inheritance law and maintains that it is possible to formulate a rule of prospective beneficiaries that correlates with entitlements and legitimate claims without necessarily acquiring the status of rights. The second extends expectancies to future persons and concludes (...) that the latter can be considered present holders of such currently binding entitlements. The third section raises the question of whether democracies are bound to a principle of fidelity towards expectancies in such a way that outweighs current people’s rights in cases of conflicts. The response does not prove particularly future-beneficial in such cases. However, section four clarifies why expectancies still carry a crucial moral weight in democracies, one that is not sufficiently established by depersonalised forms of future-oriented ethics. O objetivo deste artigo é fazer uma discussão apontando para o enfraquecimento de Estados Democráticos como resultado de uma _Predação Estatal_. Predação estatal é utilizada aqui para designar um sucateamento e desordens no Estado como resultados de má administração, corrupção, entre outros fatores. Para tal, fez-se uma discussão/síntese inicial sobre a concepção de Estado/sociedade em John Rawls, buscando relacionar sua ideia de estado ideal com a concepção de Estado Democrático de Direito de autores como Rubens Casara, que, a princípio, dialoga (...) de forma a concordar com a teoria da justiça de Rawls. Se percebeu, nesse sentido, que as concepções desses dois autores vão na contramão da predação estatal, pois esta última consiste na ausência de elementos como democracia, organização do Estado, garantia de direitos, entre outros, apontados por Rawls e Casara. Assim o trabalho foi escrito a partir de análise bibliográfica que versam sobre os temas em questão. A relevância do trabalho consiste na contribuição para a construção do conceito de predação estatal e _Estado Fraco_, possibilitando, dessa forma, uma ampliação da bibliografia a respeito desses conceitos, sendo este trabalho uma dessas fontes bibliográficas. Isso porque, por estarem ainda em construção, sobretudo a ideia de estado fraco, a bibliografia é rara, e praticamente não existe no Brasil. Vale ressaltar que Estado fraco não é Estado fracassado, que dispõe de maior bibliografia e tem uma concepção distinta de Estado fraco. (shrink)

This selection of some of the best writings on Spinoza's philosophy of law shows how Spinoza was able to deliver a revolutionary idea of natural law that breaks away from the traditions of natural law and of legal positivism. The collection includes several essays that have never been published in the English language before, and features an introduction which places Spinoza's writing in the context of modern jurisprudence, as well as an extensive bibliography.

Through fourteen original essays, the book seeks to understand the viability of the notion of sovereignty in a globalized world, thus taking into account the inclusion of a language of rights, limitation and legitimacy. It examines sovereignty using a normative approach.

The place of the State in Spinoza's ontology has emerged in scholarly literature as one of the most complex issues involving Spinoza's political thought. At issue is whether Spinoza's State is an actual individual with its own conatus . Some consider it a completely real individual, others say that its individuality can only be metaphoric, whilst others point out the conceptual insufficiency of this polarity for explaining the ontological status of political aggregates and try to overcome it through new concepts, (...) such as the multitude, transindividuality, and figuration. In this paper, each of these interpretations is analyzed and dismissed in favour of a new one stating that Spinoza's State is actually a dynamic network of political concepts operating in resemblance of individuality and reflecting the main characteristics of the modern Nation-State. ABSTRACT This article aims to analyze, from a Bakhtinian perspective, the grotesque construction of Mexican artist Frida Kahlo’s body through a religious worldview. Therefore, we analyze two of her self-portraits, taking into account the dialogic relations constructed between the grotesque representations and Catholic symbology. The analyzed utterances, in which the specificities of the creative competence of the author-creator in her aesthetic activity are inferred, showed that a dialogue is established between the painting El venado herido and Catholic Saint Sebastian and (...) between the painting Las dos fridas and the image of the Sacred Heart of Jesus.
